for the petitioner.
2. By the impugned order, the petitioner's
application filed under Order 16 Rules 6 & 7 CPC
to issue summons to direct the Registrar of
Fishing Boats-2, Port of Kakinada, Fishing Harbor,
Kakinada<br>to<br>produce<br>the<br>sale<br>deed<br>dated
20.05.2017 along with affidavit dated 02.01.2018
fishing boat No.FKKD 997 claimed to have been
executed by the petitioner in favour of the
defendant/respondent, has been rejected.
3. The rejection is on the ground that the
suit<br>pertains<br>to<br>the<br>year<br>2019,<br>and<br>after
completion<br>of<br>the<br>plaintiff's<br>evidence,<br>the
application was filed belatedly and no steps were
taken since 2019.<br>The learned trial Court also
observed that Order 16 Rule 1 CPC is not meant
for helping litigants who fail to adduce proper and
relevant evidence to prove their case.<br>The
learned trial Court also recorded that the issuance
of summons to the required witnesses is not
necessary and there is no merit.
4. At this stage, learned counsel for the
