THE HON'BLE SRI JUSTICE JOYMALYA BAGCHI AND THE HON'BLE SRI JUSTICE A.V.SESHA SAI

WRIT PETITION Nos.16181, 16192, 16239, 16424, 16507, 16530 and 16531 of 2020

(Taken up through video conferencing)

COMMON ORDER: (Per Hon'ble Sri Justice A.V.Sesha Sai)

Since all these writ petitions are similar and the petitioners herein share a similar grievance, this Court deems it appropriate to dispose of all these writ petitions by way of this common order.

  1. Followed by show cause notices issued by the respondent authorities and submission of explanations by the petitioners herein, the respondent authorities issued the impugned notices. A perusal of the material available on record discloses that as a sequel to the orders passed by the National Green Tribunal, the respondent authorities initiated the impugned action.

  2. This Court granted interim stay of further proceedings in pursuance of the impugned notices. Since the main issue is pending consideration before the National Green Tribunal, keeping in view the submissions of Sri K.Chidambaram, learned counsel, representing Ms. Tirumala Rani and Sri V.Surendra Reddy, learned Standing Counsel for Andhra Pradesh Pollution Control Board, this Court deems it appropriate to dispose of these writ petitions, leaving it open for the petitioners herein to approach the National Green Tribunal with necessary applications and for appropriate reliefs, if not already approached, for consideration of the same by the National Green Tribunal. So as to enable the petitioners herein to avail the said remedy, we deem it apposite to continue the

interim orders granted by this Court for a period of four weeks from today, subject to any order passed by the National Green Tribunal.

With these observations, these Writ Petitions are disposed of. No order as to costs.

As a sequel, Miscellaneous Petitions, if any, pending in these Writ Petitions shall stand closed.
