Petition under Section 151 of CPC is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to continue the petitioner till he attains the age of 62 years and to pay the salaries, Pending disposal of WP No. 12943 of 2023, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt of notice in the case).

ORDER:

Heard both sides.

Learned counsel for the petitioner would submit that, in similar circumstances, this Court passed an interim order in W.P.No.1956 of 2023 dated 30.01.2023, directing the respondents therein to continue the petitioner

therein in service and the retirement age of the petitioner is extended from 60 to 62 years.

Hence, in view of the aforesaid order dated 30.01.2023 passed by this Court in W.P.No.1956 of 2023, this Court is inclined to pass the same order in this case also.

Therefore, there shall be an interim direction to the respondents to continue the petitioner in service and the retirement age of the petitioner is extended from 60 to 62 years.
