THE HONOURABLE SRI JUSTICE D.RAMESH

WRIT PETITION No.14864 of 2022

ORDER:

The Writ Petition is filed under Article 226 of Constitution of India seeking to declare the inaction on the part of the respondent no.4 in conducting survey and demarcation for the land in an extent of Ac.5.00cents in Sy.No.366/2B/1 of Jangareddigudem village fields, Jangareddigudem Mandal, Eluru District, considering the F-line application no.FS 012101587407 dated 07.9.2021 submitted by as illegal, arbitrary and consequently direct the respondent no.4 to conduct survey and demarcate the land of the petitioner.

  1. At the stage of admission, learned Counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue would submit that the issue involved in this writ petition is squarely covered by the orders passed by this Court in W.P.No.2674 of 2020 on 19.02.2020. The learned Counsel for the petitioner would submit that the petitioner already submitted an F-line application on 07.9.2021 and requested the Court to direct the concerned authorities for considering the application and for passing appropriate orders.

  2. Heard both sides.

The learned Assistant Government Pleader for Revenue would submit that in view of the ratio laid down by the Court in the above said writ petition, the petitioner shall make a F-Line application before the concerned authority and on such application, the concerned authority would consider and dispose of the same. As the petitioner already filed an F-line application on 07.9.2021, the Court may direct the authorities for considering the same and for passing appropriate orders.

  4. In view of the same, the writ petition is disposed of at the admission stage with the consent of both sides and as per the ratio laid down by the Court in W.P.No.2674 of 2020 on 19.02.2020 by directing the respondent no.4 to consider the F-line application filed on 07.9.2021 by the petitioner and pass appropriate orders within one (1) month from the date of receipt of a copy of the order.

  5. Accordingly, the writ petition is disposed of. No costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.

Registry is directed to annex a copy of the order in W.P.No.2674 of 2020 dated 19.2.2020.
