Respondents

WHEREAS the Petitioner above named through their Advocate Venkateswara Rao Gudapati presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order or direction or writ more particularly one in the nature of Writ of Mandamus declaring action of the 3rd respondent in encashing the bank guarantees of the petitioner rice millers who are coguarantors in pursuance of the proceedings memo Lr. No.Mktg/M2/1920(3)KMS2020-21, dated 01-07-2021 as arbitrary illegal, null and void and to set aside the same and violation of Fundamental Rights guaranteed by the Constitution of India and the same is violative of principles of Natural Justice and public policy and -contrary to the supply agreement between the original rice millers and the 5th respondent and to issue consequential direction directing the respondent authorities not to encash the bank guarantee of the petitioner rice millers and if done restore the bank guarantee.

AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri Venkateswara Rao Gudapati Advocate for the Petitioner, Sri P. Hema Chandra, Standing Counsel who takes notice for Respondent No.3, directed issue of notice to the Respondents herein to show cause as to why this Writ Petition should not be admitted.

are directed to show cause either appearing in person or through an Advocate, as to why in the circumstances set out in the petition and affidavit filed therewith (copy enclosed) this WRIT PETITION should not be admitted.

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the 3<sup>rd</sup> and 5<sup>th</sup> respondent not to encash the petitioners bank guarantees of the petitioner rice millers who are co-guarantors by suspending the proceedings memo Lr. No.Mktg/M2/1920(3)KMS2020-21, dated 01-07-2021, pending disposal of WP No. 13662 of 2021, on the file of the High Court.

The Court made the following: ORDER:

Notice before admission.

Sri P.Hema Chandra, learned counsel, takes notice for the respondent-Corporation.

It is submitted by the learned counsel for the petitioners that the impugned action on the part of the respondents is illegal, arbitrary and violative of Articles 14 and 19(1)(g) of the Constitution of India. It is further submitted by the learned counsel that without taking into consideration the ground realities, the respondent-Corporation issued the impugned order.

On the other hand, it is submitted by Sri P.Hema Chandra, learned Standing Counsel for the respondent-Corporation that there is no illegality nor there exists any infirmity in the impugned action and that the Corporation has absolutely no power to extend the time also.

In reply, it is submitted by the learned counsel for the petitioners that till 07.07.2021, the petitioners herein have delivered the stock to the respondent-Corporation.

It is also the submission of the learned counsel for the respondent-Corporation that the bank guarantee of the majority of the petitioners herein have already been invoked.

The aspects pointed out in the writ affidavit have to be gone into after filing counter affidavit.

Therefore, for a period of four weeks from today, status quo as on today as regards the bank guaranties of the petitioners herein shall be maintained.
