Petition under Section <sup>151</sup> CPC is filed praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to suspend the notice issued by the 3 respondent vide Roc.A/576/2025 dt. 10.02.2025 cancellation of pattadar passbook in the name of petitioner for land in Sy.No. 183/2 an extent of Ac.0-30 cents situated in Padigalakuppam village, V.Kota Mandal, Chittoor District and by directing the respondents not to create any third party rights for land in Sy.No.183/2 an extent of Ac.0-30 cents situated in Padigalakuppam village, V.Kota Mandal, Chittoor District, pending disposal of WP.No. 11764 of 2025, on the file of the High Court. rd
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri Prakash.C, Advocate for the Petitioner and GP for Revenue for the Respondent Nos.1 to 4, the Court made the following:
ORDER:
"The present writ petition is filed questioning the notice dated 10.03.2025 issued by the 3^^ respondent.
It is the case of the petitioner that the unofficial respondents filed an appeal seeking to cancel the pattadar passbooks issued in favour of the petitioner.
This Court in Ratnamma v. Revenue Divisional Officer\ held that an appeal under Section 5(5) of the Act 26 of 1971 is not maintainable as against the issuance of pattadar passbooks.
In view of the same, there shall be an interim suspension of notice dated 10.03.2025, issued by the 3^*^ respondent.
Learned counsel for the petitioner is permitted to take out personal notice on unofficial respondents through registered post with acknowledgment due and file proof of service in the Registry.
Post after Summer Vacation, 2025.
In the meantime, the respondents are directed to file counter affidavit.
