This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:-

*"…*to issue a writ or writs more particularly in the nature of writ of mandamus declaring the impugned action of the respondent no.4 in continuing the petitioner under suspension vide impugned proceedings No. K5/86/25 Dated.28-2-2025 though the petitioner submitted his explanation to the allegations made against him, holding it as illegal, arbitrary, high handed, discriminatory, violation of principles of natural justice and cannot be justified in the eye of law and consequently direct the respondents to continue the petitioner as Field Assistant of Rangaiahgunta gram panchayat with all consequential benefits by revoking the impugned order of suspension vide proc No.K5/86/25 dt 28-2- 2025 in the interest of justice and pass such other order or orders.…"

  1. Heard Sri Ch Srinivas, learned counsel for the petitioner, learned Assistant Government Pleader for Services-I for respondent Nos.1 and 3, Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondent Nos.2, 4 and 6 and Smt B.V.Aparna Lakshmi, learned Standing Counsel for respondent No.5.

  2. Petitioner has been appointed as Field Assistant of Rangaiahgunta Gram Panchayat, K.V.B.Puram Mandal, Tirupathi District, in the year 2011. Basing on certain allegations, he has been placed under temporary removal/suspension vide Notice No.K5/86/25, dated 28.02.2025, issued by the 4th respondent, and he was also called upon to submit explanation. Petitioner submitted explanation on 15.03.2025. However, the inquiry is stated to be still going on.

  3. Learned counsel for the petitioner submits that inspite of submitting aforesaid explanation, though Clause 13B(5) of the Field Assistants Human Resource Policy provides for completion of disciplinary proceedings within thirty (30) days, the respondents have not concluded the same.

  4. Sri M.S.R Chandra Murthy, learned Standing Counsel for respondent Nos.2, 4 and 6 submits that inquiry is at an advanced stage and will be concluded soon.

  5. In view of aforesaid submissions, without expressing any opinion on merits of the matter, with the consent of both the learned counsel, the Writ Petition is disposed of at the admission stage, directing respondent No.4 to conclude the inquiry and pass appropriate speaking orders, after providing due opportunity of hearing to the petitioner, within a period of three (03) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, miscellaneous petitions, pending if any, shall stand closed.
