HON'BLE SRI JUSTICE G.NARENDAR AND HON'BLE SRI JUSTICE T.C.D. SEKHAR
WRIT APPEAL Nos.521, 522, 523 and 524 of 2024
COMMON JUDGMENT:- (per Hon'ble Sri Justice G.Narendar)
-
Heard the learned counsel for the appellant-University and the learned counsel for the respondents.
-
The facts are not in dispute.
-
After hearing for some time, the learned counsel for the respondent on being pointed out the U.G.C. guidelines along with the material papers in the Writ Petition would submit that the Writ Appeals could be disposed of by directing the University to strictly abide by the guidelines, dated 28.01.2019, issued by the University Grants Commission (U.G.C.).
-
He further contends that the terms of employment of Guest Faculty be in terms of the U.G.C. guidelines noted supra.
-
The learned counsel for the appellant-University would also submit that the University is now following the guidelines issued by the U.G.C. and would also follow the guidelines that may be issued by the U.G.C from time to time in matters relating to appointment, continuation and removal of Guest Faculty and also with regard to the payment of honorarium to the Guest Faculty.
-
In the light of the submissions made by the both the counsels, the order impugned requires to be set-aside and is accordingly, set-aside.
-
The Writ Appeals are disposed of by placing on record the submission of the learned counsels.
-
The parties shall strictly abide by the representations made to this Court. It is needless to say that the U.G.C. being the authority competent in the matters of stipulation of qualification, eligibility and salary in respect of the teaching faculty in Universities, it goes without saying that the parties shall strictly abide by the same.
-
Accordingly, the Writ Appeals are disposed of. There shall be no order as to costs.
2
As a sequel thereto, the miscellaneous petitions, if any pending, shall stand closed.
