The Court made the following:

ORDER:

This Writ Petition under Article 226 of the Constitution of India is filed seeking the following relief:

"…..to call for the records and issue a WRIT OF MANDAMUS declaring the action of the 1st respondent in Memo.No.17620/M II1/2015-7, dated 17.02.2016 as arbitrary, illegal, unjust unconstitutional null and void and contrary to the Rules framed vide GO.Ms.No.20 Industries and Commerce Department, dated 15.01.2016 apart from fundamental rights guaranteed under Article 19 of Constitution of India and consequently direct the respondents to

process the tender of the petitioner Buyer Registration No.72532 given by MSTC in respect of Ramaiahpeta 16896 Sand Reach Polavaram Mandal West Godavari District...."

  1. Heard Mr G.Raja Babu, learned counsel for the petitioner and the learned Assistant Government Pleader for Mines and Geology appearing for the respondents.

  2. On hearing, learned Assistant Government Pleader for Mines and Geology appearing for the respondents submits that as the period mentioned in the auction notification expired long back, no cause survives in the Writ Petition and the same may be closed.

  3. Recording the submission of learned Assistant Government Pleader, this Writ Petition is closed. However, the respondents are directed to refund the amount if any paid by the petitioner with regard to the subject tender notice. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed.
