THE HON'BLE SRI JUSTICE R.RAGHUNANDAN RAO
WRIT PETITION No.13377 of 2022
ORDER:-
The petitioner, who has a quarry lease for Colour Granite, had received a Demand Notice bearing No.2120/Q2/C.G/2010, dated 24.12.2020, issued by the 3rd respondent, demanding an amount of Rs.2,19,45,140/-. Aggrieved by the said order, the petitioner had approached the 1st respondent, by way of a revision. This revision was dismissed by the 1st respondent by Memo bearing No.9323/M.I(1)/2021, dated 22.11.2021. Aggrieved by the said order of dismissal, the petitioner has approached this Court.

Heard Sri G.Raja Babu, learned counsel for the petitioner and the learned Government Pleader for Mines and Geology.

A perusal of the said order shows that the revisional authority has not given any reasons for dismissing the revision application of the petitioner.

Non furnishing of reasons in a quasi judicial order of this nature is a clear case of violation of principles of natural justice requiring the interdiction of the Court.

Accordingly, this writ petition is allowed by setting aside the impugned Memo bearing No.9323/M.I(1)/2021, dated 22.11.2021 and the revision is remanded back to the 1st respondent, to consider all the objections of the petitioner, and to pass an order giving reasons.

Needless to say, the petitioner shall also be entitled to have a personal hearing. Further, no coercive steps shall be taken against the petitioner pending disposal of the revision. There shall be no order as to costs.
Miscellaneous petitions, pending if any, in this Writ Petition shall stand closed.
