THE HON'BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.12222 OF 2023

ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

"….. to issue any writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in nonpayment of the bill amounts to a tune of Rs.1,36,23,178/- (Rs.87,97,388/- by 1st petitioner and Rs.48,25,790/- by 2nd petitioner) in total in pursuance of the proceedings i) RC No.A3/10/2019 dt.24-02-2020 issued by the 4th respondent ii) RC No.B1/55/2019 dt. 06-01-2020 issued by the 5th respondent iii) RC No. A3/188/2019 dt.18-12-2019 issued by the 6th respondent and iv) Rc No.C2/331/2019 dt.15.11.2019 issued by the 7th respondent for the books and other study material supplied to various institutions as per the requirement of the respondents 8 to 11 as illegal, arbitrary and consequently direct the respondents to pay the bill amounts to a tune of Rs.1,36,23,178/- (Rs. 87,97,388/- by 1st petitioner and Rs.48,25,790/- by 2nd petitioner in the interests of justice and to pass…."

  1. Heard learned counsel for the petitioners, learned Assistant Government Pleader for Social Welfare appearing for respondent Nos.1, 3 to 11 and learned Assistant Government Pleader for Finance and Planning Department appearing for respondent Nos.2, 12 to 15.

  2. Learned Assistant Government Pleader for Social Welfare, on written instructions dated 24.08.2023, which is placed on record, submitted that, the bill amount of the petitioners have been admitted by the authorities, uploading process is made and CFMS IDs were also generated and it is waiting for fund clearance. As and when the funds are cleared, they are ready to pay the legally entitled amount to the petitioners and sought three (03) months time for such payment.

  3. To the said submission, learned counsel for the petitioner reported no objection.

  4. In view of the above, with the consent of learned counsel for both the parties, this Writ Petition is disposed of at the admission stage.

  5. Accordingly, the respondents are directed to release the admitted/legally entitled amount to the petitioner at the earliest and at any rate, within a period of three (03) months from the

date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
