Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant stay of all further proceedings including passing of final decree in O.S.No.73/2016 on the file of IX Additional District Judge, at Kovvur, West Godavari District, pending disposal of AS No.401 of 2023, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order. (The receipt of this order will be deemed to be the receipt of notice in the case).

ORDER:

"Heard learned counsel for the petitioner/appellant and the learned counsel for the respondent.

This petition is filed seeking stay of all further proceedings in pursuance of the Decree and Judgment passed in O.S.No.73 of 2016 dated 23.03.2023 on the file of IX Additional District Judge at Kovvur, West Godavari.

The suit is preliminarily decreed for partition relating to the plaint schedule property into two equal shares and allot one such share to the plaintiff.

The defendant preferred the present appeal aggrieved by the same.

Since the Appeal takes some time for disposal, except passing final decree, all further proceedings in O.S.No.73 of 2016 can continue."
