Petition Under Section 24 of C.P.C. Praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to withdraw the H.MO.P.No.239 of 2019 which is pending on the file of the Court of The Senior Civil Judge, Nuzvid, Krishna District and transfer the same to the court of the Prl. Senior Civil Judge, Eluru, West Godavari District.

The petition coming on for hearing, upon perusing the petition and affidavit filed herein and Order of High Court dated 08-07-2021 made herein and upon hearing the arguments of Sri Ramakrishna Akurathi, Advocate for the Petitioner, and Sri Madhava Rao Nalluri, Advocate for Respondent, the Court made the following

ORDER

This Tr.C.M.P. is filed tinder Section 24 of the C.P.C. by the wife seeking transfer of the H.M.O.P.No.239 of 2019 filed before the Senior Civil Judge's Court, Nuzvid, Krishna District by the husband seeking dissolution of the marriage on the ground for cruelty.

When the matter is taken up on 20.09.2021, it is stated that the matter is going to settle out of the Court. The petitioner is working as Assistant Professor, Anesthesia Department in Alluri Seetharamaraju Academy of Medical Sciences at Eluru, West Godavari District. The respondent has been working as Doctor in Madhuri Nursing home, Ravuri Somaiah Nagar, Tanguturu Village and Mandal, Prakasam District.

The petitioner is aged about 28 years and the respondent/husband is aged about 30 years. Both the parties are highly educated but not able to settle the family dispute amicably by conciliation.

In those circumstances, this Court is constrained to order the appearance of the both the parties before this Court.

Post the matter on 03.12.2021.

Registry is directed to communicate this order to both the parties for their appearance.

Learned counsels also permitted to communicate the same.
