Petition under Order 41 Rule 5 of C.P.C. is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant stay of execution of Decree passed by Motor Accidents Claims Tribunal -Cum- II Additional District Court (MACT), Amalapuram passed in M.V.O.P.No. 06/2019 dated 19.01.2024, Pending disposal of MACMA No. 325 of 2024, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order. (The receipt of this order will be deemed to be the receipt of notice in the case).

ORDER

"Heard learned counsel for the petitioner.

Considering the submissions and for the reasons stated in the accompanying affidavit filed in support of this application, there shall be interim stay of execution of Decree passed in M.V.O.P.No.06 of 2019, dated 19.01.2024 on the file of Motor Accidents Claims Tribunal-Cum-II Additional District Court(MACT), Amalapuram, subject to condition that the appellant deposit 50% of the awarded amount along with proportionate costs and interests to the credit of the above O.P. within a period of eight (08) weeks from today."
