THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY

WRIT PETITION NO.12187 OF 2021

ORDER:

This petition is filed under Article 226 of the Constitution of India, seeking the following relief:

"to issue a Writ, Order or Direction more particularly one in the nature of Writ of mandamus, declaring the action of respondents especially 3rd respondent in not mutating the petitioner's name in respect to the land admeasuring Ac.3-39 cents in Sy.No.103 of Gudali Revenue Village, Kota Mandal, SPSR Nellore District, though she has filed a claim on 17-12-2020 and 23-01-2021 through A.P. Online, as illegal, arbitrary and against the principles of natural justice and against the provisions of the A.P. Rights in Land and Pattadar Passbooks Act, 1971, and consequently direct the 3rd respondent to mutate her name in the revenue records in respect to the subject land by considering her claim and pass such other orders".

Though the petitioner made several allegations, during the course of hearing, learned counsel for the petitioner Sri Seshadri Goalla requested this Court to issue a direction to the 3rd respondent to dispose of the applications, dated 17-12-2020 and 23-01-2021 filed by the petitioner through Mee-seva without touching the merits.

In view of limited request made by the learned counsel for the petitioner, the 3rd respondent is directed to dispose of the applications, dated 17-12-2020 and 23-01-2021 filed by the petitioner, in accordance with law, though this Court is conscious about the principle laid down by the Honourable Apex Court in "The Government of India v. P.Venkatesh1", wherein the Honourable Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they

do not serve to the cause of justice. As the learned counsel for the petitioner himself requested to issue a direction to the 3rd respondent to dispose of the applications, dated 17-12-2020 and 23-01-2021 filed by the petitioner, I find no other alternative except to issue such direction.

  1. In the result, Writ Petition is disposed of, directing the 3rd respondent to dispose of the applications, dated 17-12-2020 and 23-01-2021 filed by the petitioner, in accordance with law, within four (04) weeks from today. There shall be no order as to costs.

Consequently, miscellaneous applications pending, if any, shall also stand closed.
