THE HON'BLE SRI JUSTICE D. RAMESH
WRIT PETITION No. 12171 of 2022
ORDER:-
This Writ Petition under Article 226 of the Constitution of India is filed seeking to direct the 4th respondent not to interfere with the peaceful possession and enjoyment of the land of the petitioner in an extent of Ac.0.55 cents in Sy.No.99-2 of Porumamilla Village and Mandal, YSR Kadapa District pursuant to the notice in reference No.B/24/2022, dated 04.02.2022 on the file of the 4th respondent.
Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents.
The contention of the learned counsel for the petitioner is that basing on the application made by the 5th respondent for sub-division of the subject property, the 4th respondent has issued notice on 04.02.2022 to the petitioner and the 4th respondent and his staff started interfering with the possession of the petitioner over the subject land. Aggrieved by the same, the present Writ Petition is filed.
On perusal of the Adangal/Pahani filed along with this Writ Petition clearly discloses the name of the petitioner in the pattadar column which was downloaded from the online portal on 16.12.2021.
Notice to the 5th respondent is dispensed with as no specific allegations are made against the 5th respondent.
In view of the facts and circumstances of the case, this Writ Petition is disposed of directing the respondents not to interfere and
1
dispossess the petitioner from the subject land without following due process of law. There shall be no order as to costs.
As a sequel thereto, interlocutory applications, if any, shall also stand closed.
