The Court made the following ORDER:

The above contempt case is filed in violation of the order dated 16.02.2012 in W.P.No.23536 of 2010.

  1. Questioning the inaction of 1st respondent in not considering the case of the petitioner for allotment of open plot admeasuring 3.5 cents in Sy.No.777/A2/2 of L.P.No.160/90, as alternative plot, the petitioner filed the writ petition.

  2. The writ petition was disposed of at the stage of admission directing the 1 st respondent to consider the representation dated 28.06.2008, stated to have been made by the petitioner to the 1st respondent seeking alternative site, and pass appropriate orders per law, within four weeks from the date of receipt of a copy of the order.

  3. Complaining about the non-implementation of the order in the writ petition, the above contempt case is filed.

  4. A counter-affidavit was filed on behalf of the 2nd respondent. In para No.12 of the counter-affidavit, it was mentioned that the proceedings dated 29.05.2012 were issued rejecting the claim of the petitioner, in pursuance of the petitioner's representation dated 28.06.2008. Thereafter, the Government also issued Memo No.6363/J1/2012-4, dated 12.07.2012. No reply was filed by the petitioner to the counter-affidavit.

  5. Since the order in the writ petition was complied with, there is no violation of the order and hence, no orders are required in the contempt case.

  6. Accordingly, the contempt case is closed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
