ORAL JUDGMENT

Being aggrieved by the order dated 29.02.2020 passed by learned single Judge allowing W.P.No.8318 of 2015 setting aside the proceedings dated 31.01.2015 issued by the 5th respondent therein-Project Director, District Rural Development Agency, YSR Kadapa District and directing the respondents therein to forthwith

reinstate the writ petitioner into service with all attendant benefits, this writ appeal has been preferred.

  1. We have perused the facts of the case as narrated in detail in the writ petition. This Court has also considered the response so filed by the respondents in the writ petition. On perusal of the impugned order, it reveals that the termination proceedings relate to the issue of the writ petitioner not joining at T.Sundupalli. In the circumstances in which the writ petitioner was not allowed to join duty at Mydukur wherefrom again posting has been made to T. Sundupalli, learned single Judge found merit. Having referred the subsequent events, learned single Judge further observed that even after revoking suspension and giving orders posting him at Mydukur, the writ petitioner was paid subsistence allowance.

  2. Considering all these aspects, after hearing the learned Counsel for the appellant and the respondents, we are of the considered view that the reasoning assigned by learned single Judge does not warrant any interference in the facts of the case.

  3. Accordingly, the Writ Appeal is dismissed. No costs. As a sequel all the pending miscellaneous applications shall stand closed. The order of learned single Judge be now complied with, within a period of one month from today.
