THE HON'BLE SRI JUSTICE BATTU DEVANAND CONTEMPT CASE NO.1411 of 2022 AND WRIT PETITION NO.5701 of 2022

COMMON ORDER:

The W.P.No.5701 of 2022 is filed by the petitioner against the action of the 4th respondent in not taking any action pursuant to the proceedings in Rc.No.1030/B5/B9/C5/2021, dated 06.10.2021 issued by the 3rd respondent releasing an amount of Rs.55,45,842/ towards the maintenance of grant @ 6% for the years 2017-18, 2018-19 and 2019-20 to all the schools including the petitioner's school which is mentioned at serial NoS.18 and 19 entitling Rs.3,57,201/- and Rs.2,73,131/ respectively and consequently issuing proceedings Rc.No.1030/AS/2021, dated 02.02.2022 reflecting the same and further direct the 4th respondent to immediately release the amounts covered under the proceedings in Rc.No.1030/AS/2021, dated 02.02.2022.

  1. This Court passed an interim order on 09.03.2022 in I.A.No.1 of 2022 directing the respondents to release the amounts payable to the petitioner towards

maintenance charges @ 6% forthwith. Complaining non compliance of the order of this Court in I.A.No.1 of 2022, the petitioner filed C.C.No.1411 of 2022.

  1. Today, both the cases are taken up for hearing. During the course of hearing, the learned counsel for the petitioner and the learned Government Pleader for School Education submit that the interim order passed by this Court on 09.03.2022 is complied with on 08.06.2022 and the maintenance charges @ 6% were released in favour of the petitioner.

  2. In view of this factual position, in the considered opinion of this Court, no further orders are required in these petitions.

  3. Recording the submissions made by the learned counsel for the petitioner and the learned Government Pleader, the Writ Petition is closed as no further orders are necessary and the Contempt Case is closed.

  4. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in these cases shall stand closed.
