Writ Petition No.12001 of 2021

Order:

Heard learned counsel for the petitioner and Sri Sivaram, junior counsel representing Mr.Y.Nagi Reddy, learned standing counsel for respondents.

Learned counsel for the petitioner has also filed a copy of the order in W.P.No.11719 of 2020 in which an order was passed reinstating the service of the petitioner therein, by setting aside the termination order, on the ground, even though he is a temporary employee or a probationer, he is entitled to a notice particularly when an order carries a stigma. The learned Single Judge held that if an order is passed in such cases, there is a need for an enquiry and that rules of natural justice etc., are to be followed. The learned Single Judge set aside the termination of the petitioner therein.

In the present case on hand, it has noticed that basing on the report of an Inspector of Police, the services of the petitioner was terminated with effect from 22.02.2020.

Both the learned counsel agree that the issue in the present writ petition is squarely covered by the order passed in W.P.No.11719 of 2020.

Hence, there shall be a direction as prayed for, and the writ petition is allowed setting aside the impugned order dated 30.05.2020, terminating the service of the petitioner.

It is made clear that this order will not preclude the respondents to take appropriate action in accordance with law and complying with the rules of natural justice.

With these observations, the writ petition is allowed setting aside the impugned order. There shall be no order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
