WHEREAS the Petitioners above named through their Advocate Sri O Manoher Reddy, presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the proceedings of the 3^rd respondent issued in Form No.V signed on 12.05.2021 directing eviction of the petitioners shown at SI.No.19, 20, 21 and 23 of the schedule to the notice from the plots in Sy.No.106/1 of Papampeta Village, Anantapuramu Rural Mandal, Anantapuramu District as illegal, arbitrary and one without jurisdiction.

AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri O Manoher Reddy Advocate for the Petitioners, GP for Revenue for Respondent Nos 1 to 4, directed issue of notice to the Respondents herein to show cause as to why this WRIT PETITION should not be admitted.

are directed to show cause either appearing in person or through an Advocate, as to why in the circumstances set out in the petition and affidavit filed therewith (copy enclosed) this WRIT PETITION should not be admitted.

IA NO: 1 OF 2021

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to suspend the proceedings of the 3rd respondent issued in Form No.V. signed on 12.05.2021 for eviction of the petitioners mentioned at SI.NO.19, 20, 21 and 23 of the schedule to the notice from the plots in .Sy.No.1061, of Papampeta Village, Anantapuramu. Rural. Mandal, Anantapuramu District, pending disposal of WP No. 10434 of 2021, on the file of the High Court.

Heard Sri O. Manoher Reddy, learned Counsel for the petitioners. And also heard Government Pleader for Revenue for Respondent Nos 1 to 4.

Counsel for the petitioners is permitted to take out personal notice on unofficial Respondent No.5 by registered post acknowledgment due and file proof of service.

As seen from the record, the Writ Petitioners have purchased the land from the Petitioners in O.P.No. 120 of 1983. The said O.P. was allowed and on Appeal filed against the said order vide L.G.A. No. 5 of 1990, was dismissed on 30-11-1992.

Therefore, when the order of the Land Grabbing (Prohibition) Tribunal in O.P. No. 120 of 1983 is in favor of the vendors of the Petitioners, issuing a notice to them prima facie appears to be illegal.

The learned counsel for the petitioners also submits that, it is not permissible for the Revenue Divisional Officer, in the facts and circumstances of the case, to execute an order passed 28 years earlier. This is a larger question, which require adjudication at length.

Since, the connected matters are listed on 03-06-2021, the present writ petition may also be listed on that day along with the connected matters. Meanwhile, order impugned herein is suspended, maintaining "Status quo" as on today with regard to the property in dispute in all respects.
