SMT. JUSTICE T. RAJANI CIVIL REVISION PETITION No. 2440 OF 2018

ORDER:

  1. The Civil Revision Petition is filed assailing the order dated 6.10.2017 by virtue of which the learned Senior Civil Judge, Bapatla, over ruled the objection raised by the petitioner/JDR with regard to proclamation and sale of EP Schedule property.

  2. Heard learned Counsel for the petitioner and learned Counsel for the respondents.

  3. This Court, by docket order dated 17.4.2018 granted stay of all further proceedings in EP.No.2 of 2017 in O.S.No.29 of 2012 on condition of the petitioner/JDR depositing Rs.2.5 lakhs by 4.00 PM on 18.4.2018 with an undertaking before the trial Court to deposit the balance amount within six weeks from the date of the order.

  4. The learned Counsel for the petitioner/JDR submits that the petitioner has complied with the order of this Court by depositing the entire decretal amount.

  5. Learned Counsel for the respondents/DHrs does not dispute the said submission of the learned Counsel for the petitioner.

  6. In the circumstances, the order under revision is liable to be set aside.

  7. In the circumstances, the Civil Revision Petition is allowed and the order under revision is set aside. The respondents/DHrs are at liberty to withdraw the decretal amount by filing appropriate application before the Court below.

  8. Miscellaneous petitions pending consideration if any in the Civil Revision Petition shall stand closed. No order as to costs.
