SMT JUSTICE T. RAJANI
WRIT PETITION No.11957 of 2020
ORDER:
This writ petition is filed under Article 226 of Constitution of India seeking to declare the action of the 3rd respondent-Temple in not reinstating the petitioner into service as Typist in the establishment of the 3rd respondent, as illegal and arbitrary.
-
Heard the counsel for the petitioner, the Government Pleader for Endowments for the respondent Nos.1 and 2, and the Standing Counsel for the 3rd respondent-Temple.
-
The counsel for the petitioner submits that the petitioner was terminated from service and questioning the same, he filed a writ petition and obtained orders in his favour. But, the petitioner was not reinstated into service on the ground that a criminal case was pending against him. Thereafter, the petitioner was acquitted from the said criminal case, in spite of which, the respondents are not reinstating him into service. The counsel for the petitioner further submits that in that regard the petitioner gave a representation dated 11.5.2020 to the 3rd respondent, but no orders are passed since then.
-
Hence, in the above circumstances, the 3rd respondent is directed to consider the representation of the petitioner and pass appropriate orders within a period of three weeks from the date of receipt of a copy of this order.
-
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
