Order:

The present Civil Revision Petition is filed against the order dated 22.09.2016 in T.O.P.No.482 of 2016 passed by Principal District Judge, Rajamahendravaram wherein O.S.No.676 of 2015 on the file of Senior Civil Judge, Ramachandrapuram and transferred to the V Additional District Judge, Rajamahendravaram.

  1. The petitioner is the Respondent No.1 in T.O.P.No.482 of 2016.

  2. The Respondent herein filed the T.O.P.No.482 of 2016 before Principal District Judge, Rajamahendravaram, seeking to withdraw the O.S.No.676 of 2015 on the file of Senior Civil Judge's Court, Ramachandrapuram to the V Additional District Judge's Court, Rajamahendravaram for joint trial and disposal by common judgment with O.S.No.70 of 2016.

  3. The Principal District Judge while allowing the petition had taken note of the fact that the parties, the schedule property and the reliefs in both the suits are one and the same and the defence taken by the parties in both the suits is also similar. Hence, the District Judge transferred O.S.No.676 of 2015 to avoid conflict of decisions and multiplicity proceedings.

  4. This Court is of the opinion that the impugned order in the Civil Revision petition passed by the District Judge does not warrant any interference as the same would avoid possibility of conflicting orders and duplication of trial. Further, as the impugned order is of the year 2016, this Court did not inclined to interfere with the order of the District Judge.

  5. Accordingly, the Civil Revision Petition is dismissed.

No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed.
