Petition under Order -XLI, Rule-5 R/w. Section 151 of C.P.C., is filed praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to stay all further proceedings in O.S.No. 154 of 2017 on the file of III Additional District Court, Nellore dated 28-12-2021 till the disposal of the appeal filed by the petitioner against the judgment and decree in O.S.No. 154 of 2017 on the file of III Additional District Court, Nellore dated 28-12-2021, pending disposal of A.S. No. 130 of 2022 on the file of High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court dated 24-06-2022 and 29-07-2022 made herein and upon hearing the arguments of Mr. Virupaksh Dattatreya Gouda, Advocate for Petitioner, Court made the following order.

ORDER:-

"Learned counsel for the appellant reported that notices of R2 and R4 were returned unserved with an endorsements "no such person at the address of R2 and R4 and left without instructions" and therefore, fresh notices are to be ordered and whereas the notice of R5 was served and acknowledgment was submitted to the Registry.

Appearance for R1 and R3 is already made through an advocate.

Learned counsel for the appellant is permitted to take out personal service of notice on the respondents 2 and 4 through RPAD and file proof thereof.

Post on 11.10.2022.

Interim order granted earlier is extended till then".
