Petition under Order -XLI, Rule-5 R/w. Section 151 of C.P.C., is filed praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to stay all further proceedings in O.S.No. 154 of 2017 on the file of III Additional District Court, Nellore dated 28-12-2021 till the disposal of the appeal filed by the petitioner against the judgment and decree in O.S.No. 154 of 2017 on the file of III Additional District Court, Nellore dated 28-12-2021, pending disposal of A.S. No. 130 of 2022 on the file of High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court dated 24-06-2022 made herein and upon hearing the arguments of Mr. Virupaksh Dattatreya Gouda, Advocate for Petitioner, Court made the following order. ORDER:-

"It is represented by the learned counsel for the appellant that the notice sent to first respondent/plaintiff was returned unserved that the 'addressee left without instructions'. He further submitted that the notice was sent to the address as given by her in the suit. Since it is a suit for partition, the appellant is directed to issue fresh notice to the correct address of the first respondent.

Post on 02.09.2022.

Personal fresh notice to the first respondent to the correct address.

He further submitted that the notices of other respondents were also returned unserved.

Therefore, fresh notices to them as well through RPAD by personal service. Proof of service shall be filed.

Till then, interim order granted earlier is extended. "
