Petition under Order -XLI, Rule-5 R/w. Section 151 of C.P.C., is filed praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to stay all further proceedings in O.S.No. 154 of 2017 on the file of III Additional District Court, Nellore dated 28-12-2021 till the disposal of the appeal filed by the petitioner against the judgment and decree in O.S.No. 154 of 2017 on the file of III Additional District Court, Nellore dated 28-12-2021, pending disposal of A.S. No. 130 of 2022 on the file of High Court.

The Court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order. (The receipt of this order will be deemed to be the receipt of notice in the case). ORDER:-

"This petition is filed to stay all further proceedings against the judgment and decree in O.S.No.154 of 2017 on the file of III Additional District Court, Nellore dated 28.12.2021 till the disposal of the appeal.

Notice to respondents.

The learned counsel for the petitioner/appellant is permitted to take out personal service of notice to the respondents through RPAD and file proof thereof.

Post on 29.07.2022.

Till then, interim order as prayed for is granted in respect of passing final decree and the other proceedings may go on."
