that in the cause title and affidavit his name was | |||
wrongly mentioned as Sri Ramachandra Reddy. | |||
There is one more Sri Ramachandra Reddy by | |||
name working as Executive Engineer in YSR | |||
Kadapa District and this contempt case is brought | |||
to his notice and the said engineer is taking steps to | |||
discharge him from the case. In this regard, Sri | |||
Ramachandra Reddy has not appeared before this | |||
Court and such act is neither willful nor wanton. | |||
This Court issued Form 1 notice on the $6^{th}$ | |||
respondent on the ground that in spite of service of | |||
notice, he did not put up his appearance. He further | |||
submitted that he is the party contemnor in this | |||
present case and the petitioner has wrongly | |||
$6^{\sf th}$<br>impleaded Sri Ramachandra Reddy<br>$\mathbf{a}$ $\mathbf{s}$ | |||
respondent. | |||
It is not in dispute that Sri Ramachandra Naik | |||
is the concerned contemnor in the present case, the | |||
without<br>verification<br>petitioner<br>any<br>wrongly | |||
impleaded Sri Ramachandra Reddy. By virtue of | |||
the said mistake of the petitioner this Court issued | |||
Form 1 notice and the contemnor Sri Ramachnadra | |||
Naik has appeared in this regard. The petitioner | |||
without verifying the correct names, casually filed |
contempt case, by showing wrong person as contemnor. For the said mistake, this Court is inclined to order Rs.2,000/- costs to be paid by the petitioner to Sri Ramachandra Naik. At this juncture Sri Ramachandra Naik submitted that instead of paying costs to him, a direction may be given to the petitioner to pay the said costs to the Chief Minister Relief Fund.
Taking his submissions into consideration the petitioner is directed to pay Rs.2,000/- costs to the Chief Minister Relief Fund and the said amount has to be paid within a period of one (01) week.
Learned counsel for the petitioner brought to the notice of this Court that Sri Gopala Krishna Dwivedi-1 st respondent is not the present Principal Secretary of Panchayat Raj and Rural Development and Sri S.S.Ravat-2 nd respondent is not the present Principal Secretary of Finance and Planning Department and sought time to implead the present principal secretaries as party contemnors and also sought time to amend the name of the 6th respondent.
