HONOURABLE SRI JUSTICE D.V.S.S. SOMAYAJULU WRIT PETITION No.11498 of 2020

ORDER:

This Writ Petition is filed by the petitioner seeking release of her vehicle bearing No.AP 39 AB 9297 seized in connection with Crime No.184 of 2020 of S.Kota Police Station, Vizianagaram District.

Learned Assistant Government Pleader for Home, who appears for the State objects and states that the appropriate remedy is available before the concerned jurisdictional Magistrate under the provisions of Code of Criminal Procedure. The counsel for the petitioner states that in view of the Covid-19 situation he is unable to approach the court. However, learned Assistant Government Pleader for Home points out that the Hon'ble High Court has given directions to the lower Courts to take up all the matters through Video Conferencing.

In that view of the matter, this Court is of the opinion that the Writ Petition is misconceived. However, a direction is given to the concerned jurisdictional Magistrate to entertain the application for return of the seized vehicle through video conferencing and to dispose of the same on its own merits within one week of the filing of their application.

With the above observation, this Writ Petition is disposed of. No order as to costs.

As a sequel, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed.
