Criminal Appeal under Section 372 of Cr.P.C., praying that in the circumstances stated in the Memo. of Grounds filed therein, the High Court may be pleased to set aside the judgment, dated 17.11.020 in S.C.No. 105 /2015, on the file of the Court of III Additional District & Sessions Judge Nellore and convict the Respondents No. 2 to 5/Accused Nos. 1 to 4

The Petition coming on for hearing, upon perusing the petition and the grounds filed in the Criminal Appeal and upon hearing the arguments of Sri V. Roopesh Kumar Reddy, Advocate for the Petitioner and of the Public Prosecutor on behalf of respondent No.1/State, the Court made the following ORDER:

"It is an appeal against the judgment of acquittal dated 17.11.2020 passed by the learned III Additional District and Sessions Judge, Nellore, in Sessions Case No.105 of 2015.

Heard.

Appellant has made out arguable points against the judgment of acquittal. Hence, we are inclined to admit the appeal.

Notice.

Call for records.

Within a fortnight on receipt of notice, respondent Nos.2 to 5 shall appear before the trial Court and upon appearance, the trial Court shall release them on bail to its satisfaction pending hearing of the appeal, failing which the trial Court shall be at liberty to issue processes to ensure their attendance in accordance with law."
