Respondents

WHEREAS the Petitioners above named through their Advocate SRI.N.CHANDRA SEKHAR REDDY presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in nature of writ of Mandamus, declaring the inaction of on the part of Respondents 4 and 5 in taking necessary steps for laying concrete public road along with drainage system near Petitioners House bearing No. 10/1/3A, Vadde Street, Maddikera (V) (M), Kurnool District leading to the Sri Rama Temple Street is illegal, arbitrary, violation of provision 45 of THE ANDHRA PRADESH PANCHAYAT RAJ ACT, 1994 and consequently direct the Respondents 2 to 5 to take necessary steps for laying concrete public road along with drainage system near Petitioners' House bearing No.10/1/3A, Vadde Street, Maddikera (V) (M), Kurnool District, leading to the Sri Rama Temple Street;

AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri.N.Chandra Sekhar Reddy Advocate for the Petitioner, directed issue of notice to the Respondent Nos.6 & 7, herein to show cause as to why this WRIT PETITION should not be admitted.

You viz:

2. Vadde Nagaraju S/o.Vadde Thimmaiah, R/o.Vadde Street, Maddikera (V) (M), Kurnool District

are directed to show cause either appearing in person or through an Advocate, as to why in the circumstances set out in the petition and the affidavit filed therewith (copy enclosed) this WRIT PETITION should not be admitted on or before 17.08.2021, on which date the case stands posted for hearing.

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents 4 and 5 to take necessary steps for laying concrete public road along with drainage system near Petitioners' House bearing No. 10/1/3A, Vadde Street, Maddikera (V) (M), Kurnool District, leading to the Sri Rama Temple Street, pending disposal of WP No. 10019 of 2021, on the file of the High Court.

THE COURT MADE THE FOLLOWING ORDER:

Issue notice to the respondents 6 and 7.

Learned counsel for petitioners is permitted to take out personal notice to the respondents 6 and 7 and file proof of service.

The learned standing counsel appearing for the respondents 4 and 5 sought time to get instructions with regard to the action taken on the representation submitted by the petitioners.
