ORDER

The Writ Petition is filed to declare the inaction of respondents 2 to 4 in deleting the name of 5th respondent from the revenue records and canceling the pattadar passbook of 5th respondent for an extent of Ac.4.09 cents in S.No.722/1 of Rudravaram village, Kurnool Rural Mandal, Kurnool District and to mutate the name of petitioner, as illegal and arbitrary.

  1. Heard Sri Shafath Ahmed Khan, learned counsel for petitioner and learned Assistant Government Pleader for Revenue for respondents 1 to 4.

  2. When the matter was listed on 16.04.2024, learned Assistant Government Pleader for Revenue produced the endorsement issued by the 4th respondent-Tahsildar vide Rc.B.18/2024 dated 01.04.2024. A copy of the endorsement is also handed over to learned counsel for petitioner today in the Court.

  3. As seen from the endorsement, pursuant to Spandana complaint made by the petitioner on 09.11.2023, an enquiry was conducted, and the Tahsildar issued endorsement on 01.04.2024. In view of the endorsement dated 01.04.2024 issued by the 4th respondent-Tahsildar, the prayer sought for in the writ petition is misconceived and hence, it is liable to be dismissed. At this juncture, learned counsel for the petitioner sought leave to challenge the endorsement.

  4. Accordingly, the Writ Petition is dismissed giving liberty to the petitioner to challenge the endorsement issued by 4 th respondent-Tahsildar, if he is aggrieved. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
