THE HON'BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA

WRIT PETITION No. 8230 of 2023

ORDER:

The writ petition is filed under Article 226 of the Constitution of India for the following relief:

"...to issue a writ, order or direction more in the nature of Mandamus declaring the impugned action of the respondents in not preparing seniority list as per rules in force for the purpose of allocation of employees between the newly created district, thereby throwing the petitioners outside their native districts is as illegal, arbitrary, unjust and violative of Articles 14, 16 and 21 of the Constitution of India and also contrary to the orders issued by the Government and consequently direct the respondents to prepare the seniority list of A.R.P.Cs., of erstwhile Guntur Rural district and made allocations by following the procedural guidelines issued by the Government in G.O.Ms.No.31, Finance, dated 26.02.2022 and other connected orders by duly reviewing the allocations of the petitioners to Palnadu District and to pass such other order or orders...." (in verbatim)

  1. Heard learned counsel for the petitioners and learned Government Pleader for Services-I appearing for the respondents.

Learned counsel for the petitioners submits that the issue involved in this Writ Petition is squarely covered by the order dated 16.03.2023 passed by this Court in Writ Petition No.6514 of 2023 and requested to pass a similar order in this writ petition also. The same is not disputed by learned Government Pleader for Services-I appearing for the respondents.

  3. In view of the same, for the reasons alike in the aforesaid order, this Writ Petition is also disposed of directing the 4th respondent to consider the petitioners' representation acknowledged on 21.03.2023 and dispose of the same within a period of six (6) weeks from the date of receipt of a copy of this order, in terms of the order dated 16.03.2023 passed by this Court in Writ Petition No.6514 of 2023. There shall be no order as to costs.

  4. Registry is directed to attach a copy of the order dated 16.03.2023 passed by this Court in Writ Petition No.6514 of 2023 to this order.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
