3.28.06.2023Dr.KMR,J:<br>Both the learned counsels are present.<br>Sri<br>Anup<br>Koushik<br>Karavadi,<br>learned<br>counsel<br>appearing for respondent No.3, filed compliance memo,<br>enclosing a copy of the proceedings issued by the 3rd<br>respondent<br>T.O.O.(CMD)/JMD/Addl.Secy-Per)<br>vide<br>Ms.No.2863, dated 27.06.2023, wherein is stated as<br>follows:<br>"…While the functions being discharged by regular<br>employees namely Junior Assistant, Junior Engineer,<br>Junior<br>Lineman<br>etc.,<br>are<br>quite<br>different.<br>Consequently, the representation fails to satisfy the<br>criteria prescribed in State of Punjab v. Jagjit Singh,<br>(2016) SCC Online SC 1200 by the Hon"ble Supreme
Court and thereby the representation is rejected<br>prima facie".
Sri V.R. Reddy Kovvuri, learned counsel appearing<br>for respondent<br>No.2, placed on record<br>a<br>copy of the<br>letter addressed by the Chief General Manager/HRD,<br>APSPDCL, Tirupati, to the 1st<br>petitioner, wherein it is<br>stated as follows:

"…4. Further, since the matter is being pursued at the Government level as it is commonly applicable to outsourced workers working in several wings of Govt., of Andhra Pradesh. In furtherance thereof, the Govt., of AP through Special Chief Secretary held meeting on 30.01.2023 with APSPE JAC members of power sector, wherein in respect of subject issue it is resolved as hereunder. "It is informed that the Chairman/APPCC will take it up with the Government as it is a policy matter of Govt., of Andhra Pradesh." 5. As such, the Chairman/APPCC is taking steps to get the issue deliberated with the Govt., Therefore, it is informed that depending on the decision that may be taken by the Govt., on the subject issue, further necessary action will be taken by the power sector Organisation." In view of the above proceedings placed on record by learned counsel for the respondents, the respondents are directed to file their respective counters.
