Petition under Section 389(1) of Cr.P.C., praying that in the circumstances stated in the grounds filed in the Criminal Appeal, the High Court may be pleased to enlarge the petitioner/Accused on bail by way of perol for a Limited period a week relating to Sessions Case No. 11/2016 on the file of Special Sessions Judge-cum-IV Additional District & Sessions Judge, Chittoor at Tirupati in the interest of justice, pending disposal of the above Criminal Appeal No. 422 of 2019 on the file of the High Court.

The Petition coming on for hearing, upon perusing the petition and the grounds filed in the Criminal Appeal and upon hearing the arguments of Sri A.S.C. Bose, Advocate on behalf of Sri T.C. Krishnan, Advocate for the Petitioner and of the Addl. Public Prosecutor on behalf of respondent/State, the Court made the following ORDER:-

"Heard Sri A.S.C Bose on behalf of Sri T. C. Krishnan, learned counsel for the petitioner/appellant /accused and learned Additional Public Prosecutor.

This interim bail application is filed on behalf of the petitioner on the ground that petitioner's paternal uncle's son Velugu Naveen was expired on 16.07.2022 vide death certificate issued by Registrar (Birth & Death), Graama Panchayat, Nellatur, Chittoor District and that his 16th day ceremony will be held on 31.07.2022 at Nellatur Village and the petitioner being the cousin brother of the deceased, has to attend the said function. Hence the interim bail is pleaded for a period of one week.

Notice given to learned Additional Public Prosecutor, who on information confirmed the death of Sri Velugu Naveen. Besides, learned Additional Public Prosecutor would submit that there will be no law and order problem if interim bail is granted to the petitioner and he visits his village Nellatur.

It is seen that the petitioner has been serving sentence in Central Jail, Kadapa and his appeal is pending for hearing. We see no ground to discard the request of the petitioner.

Accordingly, this petition is allowed and the petitioner Velugu Naresh, S/o Mareiah is granted interim bail from 29.07.2022 to 02.08.2022 (both days inclusive) on the condition of his executing personal bond of Rs.10,000/- with one surety for the like sum to the satisfaction of the Superintendent, Central Prison, Kadapa. The petitioner shall be released on submission of the bond on 29.07.2022 and he shall report before the Superintendent, Central Prison, Kadapa before 05:00 PM on 02.08.2022."
