WRIT PETITION No.11685 of 2021

ORDER:

This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:

"to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the inaction on the part of the respondents in payment of the enhanced compensation amount in terms of Judgment dated 25.10.2018 passed by the High Court in LAAS No.426 of 2014 in accordance with law under the provisions of Section 28-A of the Land Acquisition Act as illegal, void, arbitrary and unconstitutional being violative of rights of the petitioner as enshrined under section 28-A of the Land Acquisition Act and under Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents for payment of the enhanced compensation amount in terms of Judgment dated 25.10.2018 passed by the High Court in LAAS No.426 of 2014 under the provisions of Section 28-A of the Land Acquisition Act to the petitioner in accordance with law and pass such other order…"

2. Learned counsel for the petitioner and the learned Government Pleader for Land Acquisition submitted that the issue involved in this petition is squarely covered by the order of this Court in Writ Petition No.19212 of 2020, dated 20.10.2020.

3. In view of the submission of the learned counsel for the petitioner and the learned Government Pleader for Land Acquisition, this Writ Petition is disposed of in terms of the order in W.P.No.19212 of 2020, dated 20.10.2020. There shall be no order as to costs.

Consequently, miscellaneous applications, pending if any, shall stand closed.

The Registry is directed to attach a copy of the order in W.P.No.19212 of 2020, dated 20.10.2020 to this order.
