THE HON'BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY WRIT PETITION No.8187 of 2022

ORDER:-

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home and learned Assistant Government Pleader for Revenue appearing for the official respondents.

The grievance of the writ petitioner pertains to the house site that was granted to the petitioner by the State Government. On the ground that the unofficial respondent 6 herein has been interfering with her possession in respect of the house site and making an attempt to construct a house on it, the petitioner has already approached civil Court by way of filing a suit in O.S.No.129 of 2022 on the file of the learned Principal Junior Civil Judge, Kadiri, and also obtained an ex parte ad-interim injunction order against the 6th respondent herein in I.A.No.193 of 2022 filed in the said suit. Therefore, the dispute between the petitioner and the unofficial respondent 6 in respect of the said property is pending adjudication before the competent civil Court. So, the petitioner cannot seek again another order from this Court in respect of the said dispute which is sub judice before the competent civil Court in the aforesaid suit. So, this Court does not find any valid legal ground to entertain the Writ Petition.

Therefore, the Writ Petition is dismissed. However, the petitioner is at liberty to pursue her remedy before the civil Court where the suit is pending. No costs.

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
