THE HON'BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY WRIT PETITION No.8400, 8403 and 8413 of 2021

COMMON ORDER:-

Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Panchayat Raj and Rural Development representing the respondents.

  1. These petitions are filed to declare the action of the respondents regarding non-compliance of Fund Transfer Order (F.T.R) in respect of works that were executed by the petitioners regarding supply of material to the respondents as per order issued by the 7th respondent in W.P.Nos.8400 and 8403 of 2021 and 6th respondent in W.P.No.8413 of 2021 respectively, as illegal, arbitrary and violative of the provisions of Mahatma Gandhi National Rural Development Act, 2005 and Rules made thereunder and consequently to direct the respondents to comply with F.T.Rs by paying the amount payable to the petitioners.

  2. At the time of hearing these Writ Petitions, learned counsel for the petitioners would submit that these are covered matters in view of the earlier common order passed by this Court in W.P.No.955 of 2021 and batch, and thereby prayed to pass appropriate orders in these petitions also in terms of the said common order, as the petitioners are also similarly placed with the petitioners therein.

  3. Learned Assistant Government Pleader for Panchayat Raj and Rural Development would also fairly concede that these are covered matters in view of the aforesaid common order passed by this Court in W.P.No.955 of 2021 and batch and thereby prayed to pass appropriate orders in these Writ Petitions also.

  4. Therefore, in view of the aforesaid common order in W.P.No.955 of 2021 and batch passed by this Court, these Writ Petitions are disposed of in terms of the said order, as the petitioners are similarly placed. Office is directed to enclose a copy of the said common order in W.P.No.955 of 2021 and batch, to this order. There shall be no order as to costs.

Miscellaneous petitions, if any pending, in these Writ Petitions, shall stand closed.
