The above writ petition is filed impugning the proceedings vide AP/SRO/VSP/INS/70-00-033788-000-0501/390, dated 06.12.2024 issued by the 3rd respondent under Section 45-A of the ESI Act, 1948.

Sri W.B.Srinivas, learned senior counsel assisted by Sri Kiran Kumar Vadlamudi, learned counsel for the petitioner would submit that without impleading the immediate employer, despite the objections raised by the petitioner, the order impugned is passed.

Whether the adjudication under Section 45(A) of the ESI Act without impleading or without arraying the immediate employer is maintainable requires consideration.

Given the facts and circumstances of the case, there shall be stay of all further proceedings in pursuance of order vide AP/SRO/VSP/INS/20-00- 033788-000-0501/390 dated 06.12.2024 (Ex.P.1).
