Petition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue appropriate writ order or direction particularly one in the nature of Writ of MANDAMUS declaring the action of respondents in not promoting the petitioner to the cadre of Hostel Welfare Officer (Grade-1) though she is fully eligible and qualified in the year 2008 itself. While effecting promotion in 2008 at roster point 8, unqualified candidate was promoted and at roster point 25, petitioner's junior who is at Serial No.34 in the seniority list. This action of respondents is illegal, arbitfary, being voilative of Rule 22A and Rule <sup>33</sup> and Rule <sup>37</sup> of Andhra Pradesh State and subordinate Service Rules, 1966 and Articles 14, 16 and 21 of Constitution of India and consequently direct the respondents to affect notional promotion to petitioner since 2008 with all consequential benefits and arrears of salary.

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"....to issue appropriate writ order or direction particularly one in the nature of Writ of MANDAMUS declaring the action of respondents in not promoting the petitioner to the cadre of Hostel Welfare Officer Gradel though she is fully eligible and qualified in the year 2008 itself While effecting promotion in 2008 at roster point 8 unqualified candidate was promoted and at roster point 25 petitioners junior who is at Serial No 34 in the seniority list This action of respondents is illegal arbitrary being voilative of Rule 22A and Rule 33 and ^Rule 37 of Andhra Pradesh State and subordinate Service Rules 1966 and Articles <sup>14</sup> <sup>16</sup> and <sup>21</sup> of Constitution of India and consequently direct the respondents to affect notional promotion to petitioner since 2008 with all consequential benefits and ar salary and pass...."

  1. On verifying the proceeding sheet, it is observed that, 25.07.2024, as it was represented that the learned on counsel for the petitioner has passed away, the Registry was directed to issue notice to the petitioner and the matter was directed to be pqsted to 22.8.2024

  2. Today when the matter is taken up for hearing, it is observed that notice sent to the petitioner was served, but seems that the petitioner is not interested to prosecute this none appeared on her behalf. It case.

  3. Accordingly, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.

  4. As a sequel, all the pending miscellaneous applications shall stand closed.
