Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the proceedings vide SR.No. 124/2019/S5 dated 24.12.2019 passed by the 2^nd respondent, by permitting the petitioner to supply the Essential Commodities to the eligible card holders from the petitioner's Fair Price Shop No.0129031 of Chetlathandra Village, Santhabommali Mandal, Seikakulam District, pending disposal of WP No. 8661 of 2020, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order. (The receipt of this order will be deemed to be the receipt of notice in the case).

ORDER:

"In W.P. No. 500 of 2020, while deciding the issue, this Court categorically held that when Clause 20(i) of Control Order, 2018, specified that a separate report is required to be filed by inspecting officer for initiation of disciplinary action against the petitioner therein, in the absence of any such separate report, as contemplated under Section 20(i) of Control Order, 2018, passing order based on report under Section 6-A of Essential Commodities Act, is impermissible under law, since it is deviation from Clause 20(i) of control Order, 2018.

In the instant case, learned counsel appearing for the petitioner has pointed out that the impugned order as well as the notice issued are only basing on Section 6-A of Essential Commodities Act.
