THE HON'BLE SRI JUSTICE NINALA JAYASURYA WRIT PETITION No.8488 OF 2020
ORDER:- (Heard and pronounced through Blue Jeans App(virtual) mode, since this mode is adopted on account of prevalence of COVID-19 Pandemic)
Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.
-
The grievance of the petitioner in the Writ Petition is that the respondents are trying to dispossess the petitioner from the subject matter land in the writ petition without passing any orders pursuant to the notice issued to the petitioner.
-
Learned counsel for the petitioner submits that pursuant to the notice issued to the writ petitioner dated -04-2020, the petitioner submitted the relevant documents in the office of 4th respondent. However, without passing any orders, the respondents are trying to dispossess the petitioner.
-
Learned Assistant Government Pleader on the other hand submits that if the petitioner had already submitted documents pursuant to the notice issued, appropriate orders will be passed.
-
Considering the submissions made, the Writ Petition is disposed of with a direction to the 4th respondent to pass orders by considering the case of the petitioner with reference to the documents said to have been submitted and objections, after giving due opportunity of hearing to the petitioner. Till any appropriate order is passed, the respondents are directed not to
resort to any coercive action with regard to the property in question.
- Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any pending, in this Writ petition, shall stands closed.
