HON'BLE SRI JUSTICE BATTU DEVANAND

WRIT PETITION No.8344 of 2022

ORDER:

Sri V.Sudhakar Reddy, learned counsel for petitioners submits that this writ petition has been filed against the inaction of the respondents particularly the respondents 2 to 4 in not returning/releasing the seized stock of 169.71 quintals of rice to the 1st petitioner and returning an amount of ₹50,000/- paid through challan No.53815, dated 28.02.2014 to the 2nd petitioner in pursuance of the judgment dated 08.08.2017 in Criminal Appeal No.36/2014 on the file of Principal Sessions Judge, Nellore, wherein the order dated 05.12.2014 in Rc.B.273/2013 of the 3rd respondent is set aside.

  1. A counter affidavit has been filed on behalf of the respondent. On careful perusal of the averments made in the counter affidavit, it appears that the respondent returned the seized stock of rice of 169.71 quintals to the 1st petitioner and paid an amount of refund of ₹50,000/- to the 2nd petitioner on 16.07.2022. Learned counsel for petitioners also accepted the same.

  2. In view of the above factual position, in our considered opinion, further adjudication is not warranted in this writ petition. Accordingly, this writ petition is closed.

  3. There shall be no order as to costs.

As a sequel, interlocutory applications pending for consideration, if any, shall stand closed.
