- Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.

- The petitioner was arraigned as Accused in Crime No.125 of 2025 of Bhavanipuram Police Station, Vijayawada, registered for the alleged offences under Sections 318(4), 79, 351(2) of the Bharatiya Nyaya Sanhita, 2023.

- The learned counsel for the petitioner submits that there is a difference in financial transactions between the petitioner and the 2nd respondent, the petitioner was falsely implicated in the present case. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

- Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Bhavanipuram Police Station, Vijayawada, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the purpose of investigation in connection with Crime No.125 of 2025.
