THE HON'BLE SRI JUSTICE B.KRISHNA MOHAN WRIT PETITION NO.9094 OF 2022

ORDER:

Heard the learned counsel for the petitioner and the learned Special Counsel for the respondent Nos.2 to 4.

  1. This writ petition is filed assailing the proceedings of the respondent No.4 dated 02.07.2021 terminating the services of the petitioner as Field Assistant.

  2. The counsel for the petitioner submits that the petitioner is working as Field Assistant in Kavuluru Gram Panchayath, Nalljerla Mandal, West Godavari District.

  3. While so, basing on the false allegations and complaint, the petitioner was initially placed under suspension by the respondent No.4 vide proceedings Rc.No.A2/899/HR/2021, dated 03.06.2021. Thereafter, without giving proper opportunity, enquiry was also concluded by terminating the services of the petitioner vide impugned proceedings in Rc.No.A2/899/HR/2021, dated 02.07.2021. Hence, this writ petition.

  4. On the other, learned special counsel appears for the respondent Nos. 2 to 4 submits that the enquiry was conducted duly against the petitioner on receipt of the complaints and the enquiry was concluded by following due process and accordingly, he was terminated from the services. Against which, he has got an alternative remedy to prefer an appeal. In reply, the counsel for the petitioner submits that the petitioner also preferred an appeal before the respondent No.3 which is pending without disposal.

In view of the above said facts and circumstances, the respondent No.3 is directed to dispose of the appeal preferred by the petitioner dated 26.07.2021 strictly in accordance with law as expeditiously as possible preferably with in a period of eight weeks from the date of receipt of this order.

  6. Accordingly, this writ petition is disposed of.

As a sequel, miscellaneous applications, pending, if any, shall also stand closed.
