THE HON'BLE SRI JUSTICE D. RAMESH CRIMINAL PETITION NO.2197 of 2022

ORDER:-

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 ( for short "Cr.P.C."), is filed seeking quash of order dated 04.01.2022 passed in DCSC No.03 of 2014 in PRC No.30 of 2013 by the I Additional District and Sessions Judge, Chittoor District.

  1. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent-State.

  2. The petitioner is a practicing Doctor. He filed an application before the court below u/s 317 Cr.P.C in DCSC No.03 of 2014 in PRC No.30 of 2013, seeking to dispense with his appearance on the ground that he was attending to Covid-19 Vaccination work and thereby sought adjournment. The said petition was dismissed by the court below on the ground that LWs 1 to 3 were present and that the case is of the year 2014 and further that the matter was adjourned on earlier occasion, at the request of the petitioner herein.

  3. The Learned counsel appearing on behalf of the petitioner further submitted that the petitioner being a practicing doctor, has no other option except, to attend the duties of Covid-19 Vaccination work, as per the Covid guidelines.

  4. Considering the submissions made and on perusal of the record, the order dated 04.01.2022 passed in DCSC No.03 of 2014 in PRC No.30 of 2013 by the I Additional District and Sessions Judge, Chittoor District, is hereby set-aside with a direction to the petitioner herein to be present before the court below on the next date of hearing, or else, the court below is at liberty to proceed with the matter on merits.

  5. With the above directions, the Criminal Petition is disposed of.

Consequently, Miscellaneous Petitions, if any pending, in this Criminal Petition, shall stand closed.
