The learned counsel for the petitioners<br>submits that the petitioners are arraigned as<br>Accused Nos.1 and 2, in C.C.No.154 of 2024, on<br>file Ramabhadhrapuram Police Station,<br>the<br>Vizianagaram District, for the alleged offences<br>under Section(s) $318(4)$ , $336(3)$ , $338$ , $340(2)$ read<br>with Section 3(5) of the Bharatiya Nyaya Sanhita,<br>2023 (for short, "BNS").<br>It is submitted that the allegations, even as<br>per the compliant, would not imply that the<br>petitioners have committed forgery of a purported<br>document. Even as per the complaint, the de<br>facto complainant has stated that a document<br>signed by them from the USA was sent via<br>whatsapp to the petitioners.<br>The learned counsel for the petitioners<br>further submits that the complaint is vague and<br>appears to have been filed out of vengeance.<br>It is further submitted that the complaint was<br>filed solely based on an apprehension when the
$2nd$ respondent was in India.
Considering the submission, there shall be a
stay of all further proceedings in C.C.No.154 of
2024,<br>on<br>the<br>file<br>Ramabhadhrapuram<br>Police
Station, Vizianagaram District.
In the meanwhile, the learned counsel for
the petitioners is permitted to take out personal
notice on the 2nd respondent by RPAD and file
proof of service in the Registry
Post the matter on 16.04.2025.
