Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or order or direction more particularly one in the nature of a Writ of Mandamus directing the respondents to forbear from the departmental action initiated against the petitioner Vide G.O.Ms.No.283, Home (SC.A) Department dated 15.11.2008 holding it to be illegal, arbitrary, violation of Article 14 of the Constitution of India and contrary to the judgment of the Honourable Division Bench of the Andhra Pradesh High Court reported in (2013 (4) ALT 1) and against the executive instructions issued in G.O.Ms.No.679, General Administration (Services-C) Department, dated 01.11.2008 and consequently to quash G.O.Ms.No.283 Home (SC.A) Department dated 15.11.2008.

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant interim direction directing the respondents to consider the case of the petitioner for promotion to the post of DSP (AR) without reference to the pending departmental proceedings, Pending disposal of WP 7513 of 2020, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri Ramesh Katikineni Advocate for the Petitioner and of GP for Home for the Respondent Nos.1 to 4, the Court made the following. ORDER:

"Heard learned counsel for the petitioner.

It is the submission of learned counsel for the petitioner that the charges are framed against the petitioner in the year 1999 and since then enguiry has not been completed and the case of the petitioner for promotion is not being taken up for consideration in view of the pendency of disciplinary proceedings.

Learned Assistant Government Pleader for Services-I seeks time to secure written instructions in the matter.

List the matter on 02.12.2021 in the same list.

In the meanwhile, the counter which is stated to have been returned, should be represented, after curing the defects."
