THE HON'BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY Writ Petition No.6253 of 2023 ORDER:
The grievance of the writ petitioner is that without following due process of law that respondents 4 and 5 are making an effort to acquire the property of the petitioner for the purpose of laying C.C. road. Therefore, the instant Writ Petitioner has been filed seeking a direction to the respondents 4 and 5 not to acquire the property of the petitioner without following the due process of law.

Heard learned counsel for the petitioner; learned Assistant Government Pleader for Municipal Administration and Urban Development for 1st respondent; learned Assistant Government Pleader for Revenue for respondents 2 and 3; Sri Suresh Kumar Reddy Kalava, learned Standing Counsel for respondents 4 and 5; and Sri P.Muni Reddy, learned Standing Counsel for 6th respondent.

Sri Suresh Kumar Reddy Kalava, learned Standing Counsel for respondents 4 and 5, on written instructions, would submit that there is only proposal for laying C.C. road in the land in question and till now no steps are initiated for laying the said C.C. road and it is stated that if at all the land of the petitioner is required for laying the proposed C.C. road, that they would follow the due process of law.

Therefore, recording the aforesaid submission made by the learned Standing Counsel for respondents 4 and 5, on written instructions, the Writ Petition is disposed of with a direction to respondents 4 and 5 that if at all the property of the petitioner is required for public purpose of laying C.C. road, as proposed, to follow the due process of law in acquiring the said land. Till the said due process of law is followed and the property of the petitioner is acquired, no coercive steps to dispossess the petitioner from the land in question shall be taken and no road also shall be laid through his land without acquiring the property of the petitioner by following due process of law. No costs.
Consequently, miscellaneous applications, pending if any, shall also stand closed.
