I.A.No.01 of 2023 in/and SECOND APPEAL NO.169 of 2022

JUDGMENT:

Learned counsel on both sides are in attendance. The appellants and respondent Nos.1 and 2 are physically present in the Court.

2. I.A.No.01 of 2023 is filed in terms of order 23 Rule 3 r/w 151 of C.P.C indicating an amicable compromise that is arrived at between the parties. The disputes relate to properties of the family and the parties are related to one another. This Court has interacted with the two appellants and the two respondents. They have stated that compromise is voluntary and they signed the terms voluntarily and with full knowledge of the following:

The Appellants and the respondents herein are close relatives, appellants 1 and 2 are the daughters of 2ndrespondent herein and the 1" respondent is the younger sister of the 2ndrespondent herein, the parties herein have entered into a compromise before the elders and, well wishers. Accordingly, they got executed relevant documents accepting the claim of the 1strespondent herein and registered the same vide document No 15900 of 2022 taking 07.12.2022 confirming the sale in favour of the 1strespondent by the 2nd respondent vide document No 3676 of 2006 dated 30.08.2006 registered before the sub registrar Tadipathri.

The 2ndrespondent herein executed gift settlement deeds vide document no's 15904 of 2022 dated 07.12.2022 and 15903 date 07.12.2022 in favour of the appellants 1 and 2 herein for an extent of Ac.0.87½in Survey No 1200-A and an extent of Ac.1.51 cents in Survey No 1501 of Tadipathri revenue village, Tadipathri Mandal and sub district. Ananthapuram District in favour of the 1stappellant herein and an extent of Ac. 0.01½ cents in Survey No 1200-A. Ac. 0.86 cents in Survey No 1199-A, Ac. 0.52 Cents in Survey No. 1533-A and Ac.0.40 cents in Survey No 1533-B of Tadipathri revenue village, Tadipathri Mandal and sub district, Ananthapuram District in favour of the 2nd appellant.

5. The subject property in A.S.No. 12 of 2020 on the file of VI Additional District Judge, Gooty, Ananthapuram District was also settled

between the parties and accordingly sale deed Document No. 15901 of 2022 dated 07.12.2022 for an extent of Ac.0.33½ cents in Survey No 1112-B was executed in favour of 1strespondent herein and an extent of Ac.0.12 cents in survey No 1112-B was executed in favour of 2ndappellant herein and as such there is no other subsisting claims against each other in respect of the present second appeal.

All the parties to the above appeal have settled their claims among themselves accordingly the above said documents were got executed and registered in favourof the respective parties and all the disputes were settled amicably and decided to get the compromise recorded as per the settlement arrived between them.

5. All the parties agreed and declared that they have no claim against each other regarding any of the properties of either the appellants or the respondents and undertake that they will not interfere and litigate with regard to the properties of any of the parties to the present appeal.

6. In these circumstances, the terms of compromise filed before this Court are recorded, this I.A.No.01 of 2023 in

S.A.No.169 of 2022 is allowed. Consequently, this Second Appeal stands disposed of in terms of the compromise. No orders as to costs.

As a sequel, miscellaneous petitions, if any pending, shall stand closed.
